Moon Hyung-bae, acting chief justice of the Constitutional Court, who is stepping down the next day, explains the reason for the delay in the impeachment of former President Yoon Seok-yeol (South Korea)
Moon Hyung-bae, acting chief justice of the Constitutional Court, gave a special lecture at Inha University on the 17th, just one day before his retirement, in which he explained the delay in the announcement of the impeachment trial of former President Yoon Seok-yeol.
On the same day, Acting President Moon, whose term expires on the 18th, met with around 200 students taking a course called "The Path to Law" at Inha University's Graduate School of Law.
In front of the students, he gave a special lecture titled, “Soul, Creation, Communication.” Regarding the soul, Acting Director Moon emphasized that we must constantly think about, “Why did I want to become a lawyer?”
Regarding creativity, he defined it as "original and appropriate." He said that "tong," which means communication, means "breaking through something blocked and making it flow like water," and that this requires an attitude of attentive listening.
"It is important to express one's intentions clearly," he said. During the question-and-answer session after his speech, Acting President Moon also shared his thoughts on the impeachment trial of former President Yoon Seok-yeol.
Moon asked, "What direction do you think our society should take to grow after experiencing division and turmoil over the past few months?"
In response to the question, "What is the most important thing in the world?", Acting Prime Minister Moon replied, "Tolerance is respect for those who have different opinions, and self-restraint is the appropriate use of self-restraint by those in power. Democracy cannot exist without tolerance and self-restraint.
"Impeachment is the prerogative of the opposition party, so there is no problem," he said. "But then doesn't emergency law belong to the president?"
"Whether or not tolerance and self-restraint has been exceeded, the impeachment proceedings have not gone beyond that, but it is our (Constitutional Court's) judgment that emergency martial law has gone beyond that," he said.
He also warned, "Some people say, 'Isn't there a contradiction in the impeachment declaration?' but I don't think there is a contradiction." He also said, "The rights that apply to the opposition party must also apply to the ruling party, and the ruling party must not be allowed to exercise its power."
The moderation that is required is also recognized by the opposition party, and that is integration. If the principles that apply to me and the principles that apply to you are different, how can we integrate?
"I tried to stick to that. That's the title of the impeachment document. That's why it took so long."
