A woman in her 30s, Ms. A, who was indicted on suspicion of violating the law (blackmail) filed an appeal with the Seoul High Court, Criminal Division 10-1, which heard the appeal. Ms. A is a broadcaster for a certain internet broadcasting company.
On the 2nd of this month, the appellate court sentenced Mr. A to seven years in prison. The sentence was the same as the first trial, but the court ordered the confiscation of the mobile phone used in the crime, and the original trial was formally overturned.
The second trial court confiscated one mobile phone and one smartphone device from the electronic information that was seized. Mr. A said that the original sentence was too heavy and the prosecution had not used the devices to commit the crime.
The second instance court ruled that the mobile phones and smartphones used in the crime were not confiscated, and appealed the decision on the grounds of a misunderstanding of legal principles.
The items seized included audio files of private conversations that the defendant used to blackmail the victims, and if the items are returned to the defendant without being confiscated, additional charges will be filed.
The court also ruled that "it is appropriate to confiscate one of the confiscated mobile phones and one smartphone device in accordance with Article 48, Paragraph 1, Item 1 of the Criminal Law."
Therefore, the appeal of the inspection is justified. The second instance court omitted to rule on Mr. A's argument that the sentence was inappropriate.
From September 2020 to October last year, Mr. A threatened Jun Su (Xia) and stole 840 million won.
The crime was revealed when Jun Su (Xia) filed a complaint with the investigating authorities. A posted a recording of his conversation with Jun Su (Xia).
During the closing hearing of the first trial, Mr. A's side stated, "The defendant admitted his mistake from the early stages of the investigation and has shown remorse," and "He was using drugs such as methamphetamine and was losing his senses."
"He was unable to make a rational decision and made a foolish decision in order to get money for drugs," he said. He added, "I hope that you will take into consideration the fact that he has apologized to the victim."
However, the first trial court ruled that "the defendant took advantage of the victim's weaknesses, threatened her, and stole 800 million won over a long period of time.
"Looking at the amount of the crime, the nature of the crime is very not good. The victim has suffered psychological damage and is pleading for severe punishment," he said, explaining the reason for the sentence.
