Lee Jae-myung's wife appeals second trial ruling for ”violation of the Public Offices Election Act” - South Korea
Lee Jae-myung, a member of South Korea's largest opposition party, the Democratic Party, was indicted on charges of violating the Public Offices Election Act and sentenced to a fine of 1.5 million won (approximately 156,000 yen) in the appeal court after the first trial.
Kim Hye-kyung, the wife of the next presidential candidate, has filed an appeal against the ruling of the second trial. On the 12th of this month, the Suwon High Court ruled on Kim's violation of the Public Offices Election Act (donation).
At the appeal hearing on the charges, the court dismissed the appeals filed by both sides (the defendant and the prosecutor) and reiterated the original verdict.
The high court ruled that "the meal gathering in this case (August 2021) was held by the defendant as his spouse.
The defendant was introduced to the spouse of a prominent politician in the party in order to help a certain Lee Jae-myung, and the attendees expected that the defendant would pay for the meal, as this would be beneficial for the defendant.
Taking all these factors into consideration, it can be determined that the defendant tacitly approved or condoned this, with the understanding that 'his personal attendant would make the decision.'"
After the verdict, Kim's side expressed their intention to appeal, saying they were "disappointed."
Meanwhile, the prosecution, which had sought a fine of 3 million won (approximately 312,000 yen), has not yet filed an appeal against the appellate court's ruling.
