Actor Cho Byeong Kyu lost his lawsuit against Mr. A, who had accused him of school violence. The 37th Civil Division of the Seoul Central District Court (Judge Lee Sang-Woo-won) ruled on the 1st that Cho Byeong Kyu and
The court ruled in favor of the plaintiff in a lawsuit filed by former management company HB Entertainment against Mr. A seeking damages of approximately 4 billion won (approximately 425 million yen).
The court dismissed all of Cho Byeong Kyu's claims and ordered the plaintiff to bear the legal costs.
Cho Byeong Kyu's side stated, "Mr. A's false statements have caused defamation."
"She has suffered losses totaling over 4 billion won due to being dropped as an advertising model and having appearances in advertisements, TV series, movies, and variety shows cancelled.
Mr. A must pay compensation in addition to the 200 million won (approximately 21.2 million yen) in compensation.
However, the court explained, "It is difficult to conclude that the posting is false based solely on the evidence submitted by Cho Byeong Kyu."
In addition, Cho Byeong Kyu's side claimed, "Mr. A admitted that the deletion of the relevant post was false."
He also pointed out that this was "not because he admitted that the statements were false, but because he was afraid of being sued and facing a lawsuit seeking huge damages."
Cho Byeong Kyu's side also submitted a statement denying the school violence to 20 people, but this was not accepted by the court.
The court stated that "they are all people with whom Cho Byeong Kyu had relationships in the country," and that "it is not possible to confirm the facts of the incident that occurred in New Zealand through them."
"It's difficult," he said. Cho Byeong Kyu's side has appealed the first-instance ruling. The second trial is scheduled to be held at the Seoul High Court.
Previously, on February 19, 2021, Mr. A shared information about his time studying abroad in New Zealand through online communities and social media.
On April 1, 2018, Cho Byeong Kyu posted three posts claiming to have been subjected to school violence by the school's president. Cho Byeong Kyu's side denied the allegations and began legal action, with two of the reporters stating that the allegations were false.
However, without any apology, Mr. A deleted his account and went into hiding, and the lawsuit continued.
