Former First Lady Yoon's brother, Kim Geon-hee, escapes arrest... Court says ”proof of charges is insufficient” - South Korea
Kim Jin-woo, the older brother of former First Lady Yun Kim Gun-hee, who is under investigation for allegedly providing illegal benefits in an urban development project in Yangpyeong County, Gyeonggi Province, South Korea, has escaped arrest.
According to a South Korean legal professional on the 19th, the Seoul Central District Court dismissed the arrest warrant at around 10:48 p.m. that night after conducting a pre-arrest hearing (substantive review of the warrant) on Kim.
The court stated, "In the case of the main charges, it is difficult to say that they have been sufficiently proven beyond doubt," and "As for the remaining charges, it is unclear whether the suspect has admitted the basic facts or whether there is any room for dispute."
He continued, "We took into consideration the fact that it is difficult to conclude from the submitted documents alone that there are concerns that the suspect may have concealed or escaped evidence."
Kim, along with Kim Kun-hee's mother, Choi Eun-soon, are accused of receiving unfair preferential treatment in a development project in Gongheung-ri, Yangpyeong County, and of destroying evidence.
The allegations of unfair preferential treatment stem from the fact that Kim, who ran the construction company ESI&D together with his mother Choi, built 35 houses in Gongheung-ri, Yangpyeong-gun, Gyeonggi-do between 2011 and 2016.
The case began with the construction of a 100-unit apartment building. Despite earning sales of 80 billion won (approximately 8.5 billion yen), Kim created false documents to reduce the development contribution.
The charges of destruction of evidence were made after a number of valuable items believed to have been received by Kim Kun-hee's side were discovered in an office in a nursing home run by the Kim family and at the home of Kim Jin-woo's mother-in-law.
During the hearing on the same day, Kim revealed that he had personally received the victory celebration card that was believed to have been given by former National Education Commissioner Lee Bae-yong to former President Yoon Seok-yeol and his wife.
He admitted to tearing up the documents, but also said, "I didn't know they were valuable." He added, "I acted impartially, without letting my relationship with former President Yoon and his wife influence me."
At the warrant hearing on the same day, Kim's side argued that the project documents were not false and that the development costs were not small when considering the scale of the project.
The family claimed that Kim Jin-hee frequently received gifts of gratitude, so they did not think it was inappropriate to have a golden turtle in their home.
