The court announced that defendant A, a man in his 60s who was charged with drunk driving, was sentenced to 10 months in prison, suspended for three years, and ordered him to take a 40-hour driving lesson.
Defendant A was indicted on charges of driving a car approximately 30 centimeters while intoxicated on a road in Michuhol-gu, Incheon City at around 11:30 pm on January 26th last year.
At the time, Defendant A's blood alcohol level was 0.132%, the level at which his license would be revoked. An investigation revealed that Defendant A's car had turned left first before moving forward.
At the trial, Defendant A said, "It was cold, so I was sitting in the driver's seat with the engine running," and "I put my arm down to ease the pain in my shoulder and arm, and the shift lever
He also claimed, "At that time, the gear shifted from neutral to drive, the steering wheel turned and the tires rotated, but I was not driving and there was no drunk driving intent."
However, the court did not accept Defendant A's argument. The court stated, "In this case, the brake pedal, shift lever, steering wheel, etc. that must be operated to move the car were not properly operated.
Considering the number and extent of the devices, it is clear that Defendant A drove the car with intent to drive."

However, the court ruled that "the fact that Defendant A had a history of receiving three fines for drunk driving was unfavorable to Defendant A." However, "the distance of the drunk driving incident was short, and Defendant A had no history of receiving criminal punishment since 2004,
