At 10:15 a.m. on the 4th, the Supreme Court dismissed the appeal of the three members of the criminal group who were indicted on charges of robbery and murder, damaging and concealing the body, and upheld the original ruling.
The Supreme Court stated that "the original court did not exhaust the necessary examination and judgment, and went beyond the limits of the principle of free judgment, contrary to the laws of logic and experience, and did not consider the intent and causal relationship of the crime of robbery and murder, or the conspiracy between the defendants.
"There was no error in misunderstanding the legal principles involved," he said, adding, "Considering the various circumstances that are the conditions for sentencing, we uphold the first-instance ruling in which the original court sentenced the defendants to 25 years, life imprisonment, and 30 years imprisonment.
On May 3rd of last year, the defendants picked up a Korean male tourist, Mr. D (then aged 35), in their car at a club in Bangkok, Thailand, with the intention of stealing money and valuables.
He is suspected of abducting her to Pattaya, where he strangled her to death in the car, then put her body in a large plastic can with cement and dumped it in a nearby reservoir.
Defendant A (27) tied Mr. D's hands and feet with tape, covered his eyes and mouth, and also participated in the assault in the car. Defendant B (28) and Defendant C (40) attempted to cover up the crime by interfering with Mr. D's behavior.
He also stole 3.7 million won (approximately 390,000 yen) from D's account using his mobile phone and told D's family, "If you don't send me 100 million won (approximately 10 million yen), I'll cut off all of your fingers."
The defendants had been making a living in Thailand by engaging in voice phishing and other activities, but as they were no longer able to afford it, they began to target Korean tourists for extortion.
The defendants plotted theft and scouted for victims in KakaoTalk's open chat rooms before committing the crime. The first trial sentenced defendant B to life imprisonment, defendant C to 30 years imprisonment, and defendant A to 25 years imprisonment.
Both the defendants and the prosecution appealed, but the appeal was rejected by the second trial court. The second trial court found that "the defendants stayed overseas for the purpose of voice phishing, conspired to steal money and valuables, and then committed crimes against victims they did not know.
The judge explained the reason for the sentence by saying, "Defendants B and C, who led the crime, displayed a tendency to have an extreme disregard for human life."
