DJ Yesung (real name: Ahn Yesung), who was arrested and indicted on charges of driving a car while drunk and causing the death of a motorcycle delivery man, was sentenced to prison in the first trial.
On the 9th, the Seoul Central District Court sentenced Ahn, who was arrested and indicted on charges of dangerous driving resulting in death under the Act on Aggravated Punishment of Specific Crimes, to 10 years in prison.
The court said, "Drunk driving accidents have been occurring one after another, and society as a whole has called for a solution, but they have not been eradicated," and criticized the defendant for "being negligent in causing the drunk driving accidents, but your responsibility is close to that of a deliberate crime."
The court also ruled that the defendant should be held liable for the damages. The court also ruled that the defendant was driving dangerously, speeding, crossing the center line, and violating traffic signals, and reaching a speed of 110 kilometers per hour just before the secondary traffic accident.
"The defendant was so drunk that he could not even recognize the situation," he said, emphasizing, "In particular, the defendant could have easily avoided the second accident immediately after the first traffic accident, but by not doing so, the risk was extremely high."
On February 3rd of this year, around 4:40 a.m., Ahn was driving while intoxicated with a blood alcohol content of 0.221% in Nonhyeon-dong, Gangnam-gu, Seoul, and caused two traffic accidents.
In the first accident, he was accused of fleeing the scene resulting in injury and not taking any action afterward, and in the second accident, he was put on trial for causing the death of a motorcycle delivery man in his 50s.
The court also found him guilty of the first accident. The court said, "The defendant took a picture of the vehicle's number on his mobile phone and reported it to the police.
He did not take any action to resolve the accident, and although he should have remained at the scene, he left five minutes later without any explanation," he said, explaining that his intention to flee was evident.
Prior to this, the prosecution had sought a 15-year prison sentence at the closing hearing held last month.
Although it was clear that the accident was caused by the defendant's negligence, including violation of the Road Traffic Act and speeding, the defendant tried to act as if the motorcycle driver's violation of the Road Traffic Act was the cause of the accident.
"They distorted relationships and legal principles in their claims," he said, adding, "Up to 1,500 people from across the country have submitted petitions calling for severe punishment for the defendants."
Meanwhile, Ahn's side argued for a suspended sentence, arguing that he had reached a settlement with the family and submitted 75 letters of apology, but the court did not accept this.
