On the 31st of last month, the South Korean Supreme Court sentenced a junior high school student, A (15), who was indicted on charges of murdering a relative, to 20 years in prison.
The court announced on the 4th that the original ruling that handed down the sentence has been finalized. A said that he had been accused of scolding his mother (4 years old) at an apartment in Sangdang-gu, Cheongju-si during last year's mid-autumn celebration (Chuseok, mid-autumn festival).
A was indicted on charges of brandishing a weapon at a man who was killed by a woman. At the time, A was angry about the noise coming from the playground in the housing complex. The mother was visiting her children for the mid-autumn celebration holiday.
However, A went to Sangdang Police Station in Cheongju, Chungbuk to report the incident, and her mother, upon hearing this, scolded A, saying, "You're just asserting your own rights without considering others."
A was extremely angry and took out a weapon from the kitchen, stabbing his mother about 20 times, causing her death. A had a sense of victimization and hostility towards his mother, who he believed was unfriendly and often nagged him.
The mother was taken to a nearby hospital by ambulance after her father returned home and called the police, but she later died.
After that, A was admitted to a hospital for a psychiatric evaluation and told another family member, "Because he is a delinquent, he will not be marked with a red line.
(= he will not have a criminal record). If a psychiatric evaluation reveals that he has Asperger syndrome or is mentally impaired, his sentence may be reduced."
During the trial, Party A argued that the defendant should be sent to a juvenile detention center, arguing that he was in a state of insanity or mental impairment due to a mental illness.
However, the court did not accept this, ruling that there was no evidence sufficient to prove that A was insane or mentally impaired.
A is subject to the Juvenile Law and can receive up to 15 years in prison. However, since A's crime is a specific violent crime based on the Special Act on the Punishment of Specific Violent Crimes, the first and second trial courts decided to impose the maximum sentence on A.
The court sentenced him to 20 years in prison. The court stated, "The mother ended her life in great pain due to A for a trivial reason," and "Despite the serious consequences, A continued to commit the crime.
"A was merely submitting a statement of opinion in relation to the crime that was favorable to him and that put the blame on his mother." A, who was dissatisfied with the ruling, claimed insanity or mental impairment in the second and third trials, but
The Supreme Court found no problem with the original ruling and finalized the 20-year prison sentence.
