In the appeal trial of Defendant A (34) who was indicted for violating the Air Safety Act, the prosecutor's appeal was dismissed and the original ruling was upheld. The first trial sentenced Defendant A to three years in prison, suspended for five years, and placed him on probation at least.
Both were ordered to undergo five years of mental health treatment. The court explained the reason for dismissing the appeal, saying, "The sentences imposed by the original court were neither excessive nor insufficient and were appropriately determined."
Defendant A is accused of flying an Asiana Airlines plane bound for Daegu International Airport at an altitude of 224 meters and traveling at a speed of 260 km/h on May 26, 2023.
He was tried on suspicion of operating the emergency exit lever and opening the door while descending at high speed. After the original verdict, the prosecution appealed on the grounds that the sentence was inappropriate, and Defendant A did not appeal.
Prior to this, the original court had said, "The defendant's guilt is extremely grave in that he opened the emergency door of an aircraft in flight, putting many passengers at risk and potentially causing a major accident," but added, "
He admitted to the crime, and a psychiatric evaluation showed he may suffer from schizophrenia and will require regular treatment for at least five years," the judge said in explaining the sentencing decision.
In addition to this trial, defendant A was also charged with inflicting injury, including adjustment disorders, on 15 passengers by opening the door on the day of the incident.
He was indicted and sentenced to one year and six months in prison, suspended for two years, and required 200 hours of community service in November last year.
