Supreme Court ”dismisses” Korean request to revoke ”enshrinement” at Yasukuni Shrine = Korean media
The Supreme Court dismissed a lawsuit filed by the surviving families of Korean former members of the military who had been enshrined at Yasukuni Shrine without permission, demanding the removal of the enshrinement.
In response to a lawsuit filed in 2013 by 27 Korean family members seeking to cancel the Yasukuni Shrine enshrinement, the Supreme Court ruled on the 17th that "the plaintiffs are not seeking to hold the ward responsible."
The Supreme Court dismissed the plaintiffs' claim, stating that the statute of limitations for the 20-year period had passed.
The lawsuit should have been filed within 20 years, by 1979, but since it was filed in 2013, after the statute of limitations had passed, the case is dismissed."
In the first and second trials up to this point, the court ruled that "the plaintiff's rights and interests cannot be considered to have been violated."
However, this time the Supreme Court did not rule on the infringement of the plaintiffs' rights and interests due to the enshrinement at Yasukuni Shrine.
Kim Yong Hwan, head of the foreign cooperation department at the Korea Institute for Ethnic Studies, said, "The bereaved families agreed to the enshrinement at Yasukuni Shrine.
"In fact, the Japanese government only handed over documents related to Yasukuni Shrine to the South Korean government in the late 1990s and early 2000, so the application of the statute of limitations is moot."
