President Yoon's legal team criticized the evidence in a statement on the 27th, saying, "When evidence is illegally collected, any evidence derived from it is also illegal."
This means that if evidence based on illegal acts is collected without due process, not only that evidence but also secondary evidence obtained based on it will be inadmissible.
The defense team said in a statement on the same day, "In the future, even in trials, we will not be able to fully explain the illegality of the investigative powers for the crime of treason, or the problems with the prosecution, including such illegal investigations."
"The prosecution and the public prosecutors' office, which have no investigative powers over the president, started an investigation into the president on the pretext of 'abuse of authority,'" the defense team said.
"But in reality, they put off the investigation into the abuse of their power, which they have the investigative power to investigate, and focused only on pursuing the civil war," he said. "It's a typical example of investigating the civil war based on an investigation into the abuse of power.
"It's a separate investigation into a separate matter," he said, criticizing the investigation, saying, "It has upended the Korean judicial system and has resulted in the arrest and indictment of the president. This is clearly an illegal investigation."
He also criticized the prosecutors, saying, "The prosecutors general and other prosecutors must bear full and shared responsibility."
