President Yoon's side: ”Strict rules of evidence will be applied to impeachment trial... Caution is better than speed” - South Korea
On the 5th, the lawyers for President Yoon Seok-yeol released a statement, voicing their opinion that "the Constitutional Court should consider the seriousness of the impeachment trial of the president and conduct a careful trial rather than a quick one."
President Yoon's side said today that "trials should be conducted based on strict rules of evidence, not relaxed rules," and added, "If the number of witnesses and the time for witness examination are limited, the right to cross-examine will be properly protected."
"The testimony of key witnesses regarding the facts cited in the indictment by the prosecution is unobstructed and cannot be seen through," the president's side said.
"There was a huge discrepancy between the two sides' arguments," he said, emphasizing that "eliminating the right to cross-examination while the trial is ongoing and simply letting one side's argument go is a violation of the rule of law."
As a prime example, President Yoon's side pointed out that the testimony of Hong Jang-won, the first deputy director of the National Intelligence Service, was tainted.
President Yoon's side said, "There is no evidence that the counterintelligence commander gave the order to arrest anyone, and the fact that the counterintelligence command does not have any detention facilities is also different from Hong's testimony. The memo with the arrest list is inaccurate.
He gave inconsistent testimony and was eventually questioned again by the judge and was forced to admit that he had made a mistake."
"The questioning of several witnesses in one day would be hasty and would limit the right to defense," he said.
"This will lead to a trial," he said, "and watching from the sidelines is not the attitude of a fair judge who should thoroughly clarify the facts." He also said, "Establishing the fairness of the Constitutional Court is based on compliance with due process.
We should keep in mind that it all starts with that," he added.
