Korean TV series ”Gentleman's Dignity” famous actress suffers burns after treatment... Doctor's side demands 48 million won compensation

Following an incident in which a famous South Korean actress suffered second-degree burns during a dermatological procedure, a court has ordered the doctor who performed the procedure to pay 48 million won (approximately 4.85 million yen) in damages.
On the 20th, the 18th Civil Division of the Seoul Central District Court (Judge Park Joon-min) announced that actress A had filed a lawsuit against dermatologist B in Seocho-gu, Seoul for 200 million won (approximately 20.2 million yen) in damages.
The court ruled in partial favor of the defendant in the lawsuit, ordering the payment of 48,039,295 won (approximately 4.86 million yen) in damages.
In May 2021, Mr. A was put under sedation and subjected to ultrasound laser treatment.
While undergoing a treatment to improve wrinkles, the patient sustained a wound on her left cheek. Immediately after the treatment, Doctor B did not administer any special treatment to the affected area other than applying a moist bandage.
However, the wound was diagnosed as a second-degree burn, and Mr. A has undergone more than 50 burn treatments and reconstructive surgeries to date.
It was revealed that the scars were visible even from a distance of 100 meters. This caused problems for Mr. A during the filming of the TV series, and he spent 9 hours working on computer graphics (CG) to remove the scars.
It is reported that 550,000 won (approximately 970,000 yen) was spent. A's side stated in court, "B performed three types of treatments in succession and did not follow the precautions. He also failed to adjust the intensity of the treatments, which resulted in negligence.
The court of first instance found that B had neglected his duty to adjust the intensity of the treatment and the energy supply and transmission, and acknowledged negligence.
The problem was that there were no records of the procedure and that the surgery was carried out without checking Mr. A's reaction to heat or pain while he was under anesthesia. Mr. A sought damages of 200 million won in total, but the court ruled that the existing treatment
11.16 million won (approx. JPY 1.13 million) in medical expenses, 11 million won (approx. JPY 1.12 million) in future medical expenses, 10.77 million won (approx. JPY 1.09 million) in expected loss of income, and 2 million won (approx. JPY 1.09 million) in compensation for mental anguish.
The court awarded damages totaling more than 50 million won (approximately 5.06 million yen), including the 5 million won in damages paid in the previous year. However, the court did not acknowledge liability for compensation for the CG costs of 9.55 million won.
The court explained, "Even if B knew about A's TV series filming plans, it cannot be said that he foresaw the additional CG costs that would be incurred."
Neither side appealed the first-instance ruling, and the ruling became final.
Meanwhile, Mr. A, who has been active as an actor since 2012, has appeared in TV series such as "Gentleman's Dignity," "Discovery of Romance," and "Gentleman and Lady."
He has played leading roles in such films.
