The Supreme Court held the closing hearing of the appeal trial for Mr. A, a man in his 20s who was indicted on charges of causing death by injury. The prosecution sought a 15-year prison sentence for Mr. A.
The prosecution said, "The defendant caused the victim to ingest a large amount of methamphetamine, resulting in her death. The nature of the crime was vicious and the consequences were extremely
"The circumstances after the crime were also extremely serious, including the concealment of evidence, and the first-instance sentence was too light," he argued.
He added, "The defendant was not a drug dealer, but he was involved in a drug trafficking incident in Hirosaki.
"The crime was extremely heinous, as he purchased a large amount of bong and forced the victim to take it, leading to her death," he said. "He destroyed the cell phone after the crime and concealed evidence by having others give false testimony.
The lawyer for Mr. A argued, "Mr. B did not force the victim to drink the drug-mixed drink, but drank it himself," and added, "Even if he did force the victim to drink it, there is no way to prevent the possibility of death.
"It was impossible to foresee the incident." In addition, the court submitted a conversation between A and B before the incident as additional evidence, and stated that A had no evidence of violence or obsession with his former partner.
However, A's side stated, "I admit to all the illegal drug possession charges." The sentencing hearing for A is scheduled to take place at 10 a.m. on the 30th of next month.
Mr. A was indicted in May last year on suspicion of causing the death of his former partner, Ms. B, by giving her a drink laced with methamphetamine.
The cause of death of Mr. B due to the crime committed by Mr. A was acute methamphetamine poisoning. The 3g of methamphetamine that had been mixed into his drink at the time was 0.03g, which is the recommended dosage for one dose.
The amount was found to be 100 times that of methamphetamine. The investigation revealed that Mr. A had purchased 7 grams of methamphetamine together with an acquaintance and stored it in his home and car.
The indicted Mr. A claimed that "Mr. B mixed the drugs into his drink and took them himself," but the first instance court found that "Mr. A made Mr. B take the drugs," and sentenced him to nine years in prison.
The first-instance court stated, "Human life is an irreplaceable, absolute value, and whatever the reason for violating it, it should be severely punished," and "The defendant has not apologized to the victim or expressed any feelings of guilt.
"We took into consideration the fact that he has no remorse, has actively tried to cover up the incident by destroying evidence, has shown no signs of remorse, and has denied committing the crime with unconvincing excuses," the court ruled.
