The 51st Civil Division of the Seoul Southern District Court (Chief Judge Kwon Seong-soo) dismissed the provisional injunction banning Kim from being a presidential candidate, which she filed against the People Power leadership that afternoon.
The court also dismissed a request for a provisional injunction to ban the National Committee and the Party Conference, filed by the chairpersons of the Party Council outside the National Assembly, who support candidate Kim, against the People Power leadership.
The previous day, Kim filed a petition for a provisional injunction to confirm his status as a presidential candidate, arguing that the People's Power Party should recognize his status as a presidential candidate.
The party council chairmen held a press conference at Kim's election office and said, "The leadership has forcibly convened the national committee and party conference, undermining the democratic legitimacy of candidate Kim and threatening his status as a candidate.
"It has become clear that this is a serious violation of the party's democratic management and procedures, and we cannot tolerate this," the People's Power leadership said in a statement on the 11th.
The party had decided to complete the unification of Kim and independent Han Deok-soo as a primary presidential candidate before the deadline for presidential candidate registration by the Democratic Party of Korea.
The plaintiffs had announced that they would hold a committee meeting, convene a national committee meeting on the 8th or 9th, and a party convention on the 10th or 11th.
The plaintiffs' lawyers pointed out that the party violated the requirements for convening the convention as stipulated in the party constitution and rules.
"The unification of candidate Deok-soo is in effect an attempt by the leadership to strip Kim of his candidacy," he said. He added, "(Party rules) state that delegates must be selected before the party convention.
But they haven't followed that procedure at all," he said.
