At the appeals court, prosecutors requested a two-year prison sentence for Shin Hye Sun, a member of the group SHINHWA, who was accused of driving someone else's car while intoxicated and refusing a police breathalyzer test.
According to the legal community, on the 15th, the Criminal Appellate Division 3 of the Seoul Eastern District Court (Chief Judge Kim Han-sung) held the first hearing of Shin Hye Sun's appeal.
The prosecutor's office asked the court to sentence him to two years in prison, the same as in the first trial.
Prosecutors said, ``Despite having been punished for drunk driving in the past, he committed drunk driving again and refused to take a police breathalyzer test.''
He was sentenced as a delinquent. Shin Hye Sun's attorney said, ``We regret that we made a mistake in our official status, which has a lot of influence on the public,'' but added, ``The fact that we are officially recognized means that we have to carry unconditional weight.''
"It is harsh to be punished," he said, requesting that the prosecution's appeal be dismissed. Earlier, in the first trial, the prosecution had asked Shin Hye Sun to be sentenced to two years in prison, and the court sentenced Shin Hye Sun to six months in prison and a one-year suspended sentence.
There is a history of reporting this. At that time, Shin Hye Sun's side appealed for good treatment, saying that he was suffering from depression and panic disorder. The prosecution filed a petition dissatisfied with the first instance judgment.
Shin Hye Sun is suspected of refusing to take a breathalyzer test in 2022 after getting into another person's car and getting behind the wheel while intoxicated.
After drinking alcohol in Gangnam, he got into another person's car, mistaking it for his own, and drove for about 10 km after sending a substitute driver.
He is said to have driven the train directly. The police charged Shin Hye Sun with violating the Road Traffic Act (refusing to take a breathalyzer test) and illegally using a motor vehicle, and sent Shin Hye Sun away without bond.
Shin Hye Sun had a previous history of being arrested for Drunk Driving in April 2007, and was further criticized.
As a result of this incident, Shin Hye Sun, along with other celebrities who caused social controversy, was suspended from appearing on KBS programs and appeared on variety shows.
