The court dismissed the prosecution's appeal against Shin Hye Sun, who was indicted on suspicion of refusal to take a breathalyzer test and illegal use of a motor vehicle, and upheld the original ruling.
Shin Hye Sun was sentenced to six months in prison with one year of probation in the first trial in April last year.
Shin Hye Sun, who appealed the ruling, received the same two-year prison sentence as the first trial at the first hearing on the 15th of last month.
"He was so drunk he couldn't straighten himself and refused the police's request for a breathalyzer test, so his crime is serious," they said, urging the court to impose a prison sentence.
Shin Hye Sun said, "I deeply regret and regret what I did. I will make sure this never happens again. I am sorry."

Previously, Shin Hye Sun was accused of drunk driving in someone else's car and refusing to take a breathalyzer test by police.
On the afternoon of October 10, 2022, he was drinking at a restaurant in Nonhyeon-dong, Gangnam-gu, Seoul, and then at dawn the next day, he was driving someone else's car home when he was hit by a songpa.
She fell asleep at the wheel on Dancheong Bridge 2 in Songpa-gu. Police responded to a call about a car parked in the middle of the road and asked Shin Hye Sun, who was asleep in the car, to take a breathalyzer test, but she refused.
Shin Hye Sun was also investigated for driving while drunk, about 10km from Seongnam, Gyeonggi-do to Jamsil, Seoul.
At the time, the police investigated the theft charges immediately after the owner of the car he was driving reported it as stolen, but the investigation determined that he had no intention of stealing the car.
