On the 27th, Rep. Joo Jin Woo, chairman of the People Power Party's legal advisory committee, said in a press release, "The Democratic Party of Korea
He said he was the lead sponsor of the bill, stating, "We are concerned that there will be moves to avoid returning the presidential election expenses paid for with taxpayers' money by using convenient excuses such as party mergers and splits."
According to the current Public Offices Election Law, candidates or political parties who receive a final ruling that invalidates their election must return any election expenses that have been saved.
When Lee was sentenced to one year in prison and two years of probation in the first trial for publishing false facts, the amount that the Democratic Party must return after the sentence was finalized by the Supreme Court was set at the time of the last presidential election.
The revised bill makes it clear that in cases of political party mergers and splits, the newly established or surviving political party will inherit the obligation to return the money or bear joint responsibility.
If a sentence that invalidates an election is handed down in the first or second trial, the assets of the political party in question can be seized up to the expected amount of repayment even before the sentence is finalized.
Additionally, anyone who conceals or omits assets to avoid the obligation to return them will be subject to imprisonment of up to three years or a fine of up to 30 million won (approximately 3.26 million yen).
"The revised bill will require all political parties that violate the election law to pay the tax, so the Democratic Party of Korea will have to agree to it," said Rep. Joo.
The proposed amendment also includes a provision to postpone the return of deposits and compensation for election expenses if a candidate is indicted or accused by the election management committee of a serious crime that invalidates the election.
