Moon Taeil was indicted without detention for sexually assaulting a woman together with an acquaintance. According to the legal community on the 4th, the Seoul Central District Prosecutors' Office's Women and Children's Crime Investigation Division 1 filed a criminal complaint against Taeil and two accomplices on the 28th of last month.
The two men were put on trial on suspicion of special quasi-rape under the Sexual Violence Punishment Act. They are accused of sexually assaulting a drunk woman in June last year.
It was previously reported that the police had applied suspicion of special quasi-rape to the suspect, and that he was carrying a weapon at the time of the crime.
The rumor spread, but it was later confirmed to be false. In June last year, the Bangbae Police Station in Seoul, which received the victim's report, applied for arrest warrants for the three suspects. However, the court ruled that they were not guilty of the crime.
In the end, the police summoned Taeil for questioning in August of that year, two months after receiving the report, and sent him to the prosecutor's office in September.
They claim that they did not plan the crime. Unlike their accomplices who appeared before prosecutors and were investigated, TAEIL did not respond to a summons for questioning due to health reasons.
TAEIL's side reportedly submitted a medical certificate and a lawyer's opinion. In October of last year, SM Entertainment, the agency TAEIL was affiliated with at the time, released an official statement.
In a statement, they said, "We recently confirmed that TAEIL has been accused of a sexual crime-related criminal case. After reviewing the facts, we realized that the case is very serious and decided not to continue with the investigation."
"We decided that we could not continue with group activities, and after discussing it with Taeil, we decided that he would leave the group."
